Thomas Richardson pleaded guilty to one count of receiving child pornography, 18 U.S.C. § 2252(a)(2), and one count of possession of child pornography, id. § 2252(a)(4)(B), and was sentenced to a total of 108 months imprisonment. Richardson filed a direct appeal challenging the calculation of his sentence, and we affirmed the sentence imposed by the district court. See United States v. Richardson, 238 F.3d 837 (7th Cir. 2001). Richardson then moved to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255, arguing that his trial counsel was constitutionally ineffective. The district court denied Richardsons motion, holding that he procedurally defaulted his claim because he could have raised it on direct appeal, but did not do so.
